I need to use this song in my movie. Why can't
I use the original version by the original artist?
The musical performance on the version by the original artist is comprised
of two things: the performance (or the production) which consists
of the artist's performance, the musician's performance, etc., and
the composition, which is the song. Both of these items are protected
by law and require you to obtain permission to use each item in your
project. The performance is copyrighted usually by the record company
that owns it, and the composition by the publisher of the song. You
must have permission to use the piece.
Who can get me "permission"?
You can always call up the record company and ask them what they will
charge for this use of the production. However, rest assured that
the fees they will charge for use of an original production of a song
will be anywhere from $0 to millions - they have the right to ask
whatever they want. AND they'll ask you enough questions about your
usage to make sure they make money on it! This is an expensive and
time-consuming process - and it doesn't guarantee that you can use
the piece in your project.
The composition has a different angle - usually the composers of the
song WANT more uses for their song (as you know, many songs are sung
my many different artists - there are HUNDREDS of versions of the
song "Yesterday" by the Beatles ranging from punk bands to the Marine
Corps Band!).
Who can get me "the rights"?
Many people use a CLEARANCE or RIGHTS CLEARANCE company that (for
a small fee) negotiates these fees for you. Usually they have cleared
these songs before and can quote you immediately (a real issue because
many record companies see rights clearance as the lowest priority
- taking weeks or months to agree to clearance). The bottom line,
however, is that clearing the "big hits" is chancy and expensive.
How is using Blank Production's version of the
song going to save me money?
